Terms of Service

This store is operated by Hörner GmbH, Oskar-Röder-Straße 3, 01237 Dresden, Germany ("Hörner", "we", "us"). By placing an order you agree to these Terms, our Privacy Policy and our Shipping & Returns policy. This store sells and ships within the United States only. If you are in the EU, please shop at hoerner-group.de.

You must be at least 18 years old (or the age of majority in your state) and able to enter a binding contract to order from this store.

Your order is an offer to buy. A contract forms when we send an order confirmation. We may decline or cancel an order (for example, if an item is unavailable, if there is an obvious pricing or description error, or if we suspect fraud). If we cancel after payment, we refund you in full.

Prices are shown in US dollars. We accept the payment methods shown at checkout. Import duties are prepaid on standard routes, so there is nothing extra to pay on delivery. Any applicable US sales tax is shown at checkout before you pay. Title and risk of loss pass to you on delivery to the carrier for shipment to you.

We ship from Germany to addresses within the United States. Delivery times, costs and the duties-prepaid arrangement are described in Shipping & Returns. Free shipping applies to orders that include a full-price item; low-price-only orders carry a flat shipping fee shown before checkout.

You may return an unused item in its original condition within 30 days of delivery, as set out in Shipping & Returns. Personalized or engraved items are made to order and cannot be returned unless they arrive faulty or incorrect, in which case we cover the return and send a replacement or full refund.

We work to describe products accurately, but small variations in color, grain and finish are natural in leather and wood and are not defects. Origin: our pieces are designed in Germany. Our leather goods are crafted by our manufacturing partners in China and India; our fountain-pen nibs are made by JoWo in Germany. "Designed in Germany" and "made to a German standard" refer to our design and quality standards, not to the country of manufacture of the finished goods.

We stand behind our craftsmanship and will address genuine manufacturing defects. Except for this and any rights you have under applicable law, products are provided "as is" and we disclaim implied warranties of merchantability and fitness for a particular purpose to the fullest extent permitted by law. Some states do not allow certain disclaimers, so parts of this section may not apply to you, and nothing here limits rights that cannot be limited under your state's law.

To the fullest extent permitted by law, Hörner is not liable for indirect, incidental or consequential damages arising from your use of the store or our products, and our total liability for any order will not exceed the amount you paid for that order. Nothing here excludes liability that cannot be excluded by law.

The Hörner name, logo, product designs, text and images on this site are owned by Hörner GmbH or its licensors and may not be used without our permission. Third-party names (such as JoWo) are the property of their respective owners and are used only to describe components.

These Terms are governed by the laws applicable to Hörner GmbH, without depriving you of the mandatory consumer protections of the US state where you reside. If a dispute arises, please contact us first at info@hoerner-group.de so we can try to resolve it. [The exact governing law, venue and any arbitration provision are being finalized with counsel.]

We may update these Terms from time to time. The version in force is the one published here when you place your order, shown with the date below.
